As technology and the Internet are rapidly changing, this Policy may change from time to time to reflect those changes. Legal Basis for Processing Your Personal Information

We process your Personal Information based on one or more of the following legal bases:

  • Consent, where you have provided clear consent for us to process your Personal Information for a specific purpose. 
  • Contractual Necessity, where it is necessary to process your Personal Information to fulfill a contract with you or to take steps at your request before entering into a contract.
  • Legitimate Interests, where processing is necessary for our legitimate interests unless your interests or fundamental rights override those interests.
  • Compliance with Legal Obligations, where it is required by law for us to process your Personal Information.

These are examples of the reasons we process your Personal Information that fall under one or more of the above legal bases.

  • To fulfill or meet the reason you provided the Personal Information. For example, if you share your name and contact information to request a price quote or ask questions about our products or services, we will use that Personal Information to respond to your inquiry.  If you provide your Personal Information to purchase a product or service, we will use that Personal Information to process your payment and facilitate delivery. Information We Collect Through Automatic Data Collection Technologies

We automatically collect information about when you visit our Website and when you use our mobile applications (“Apps”).

  • When you visit our Website, we use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns such as traffic data, location data, logs, and other communication data and the resources that you access and use on the Website so that we can:

We do not sell or rent your Personal Information. We do not share your Personal Information for any commercial or marketing purposes that are unrelated to the delivery of Zircon products and services. When we share or disclose Personal Information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract. In the preceding twelve (12) months, We have disclosed the Personal Information we collected from you for a business purpose to our business partners or service providers.  We did not collect and, therefore, did not disclose any sensitive or Special Category Personal Information.

Data Retention

We retain your Personal Information only for as long as necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law. The criteria we use to determine retention periods include:

  • the length of time we have an ongoing relationship with you;
  • whether there is a legal obligation to retain the data; and
  • whether retention is advisable considering our legal position in accordance with any applicable statutes of limitations, litigation, or regulatory investigations.

Your Rights and Access to Personal Information

You have the following rights with respect to your Personal Information:

  • the right to access your Personal Information;
  • the right to update your Personal Information by emailing us;
  • the right to withdraw your consent, or to port your data, with respect to your Personal Information that is collected on the basis of your consent;
  • the right to request erasure of your Personal Information or object or otherwise restrict its processing; and
  • the right to lodge a complaint with us or, as applicable, with a supervisory authority, if you believe that our processing of your Personal Information infringes data protection laws.

We will endeavor to honor your request to delete any of your Personal Information that we collected and retained, subject to certain exceptions. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you;
  • detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  • debug products to identify and repair errors that impair existing intended functionality;

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative. 
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.  Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.  Our disclosures will only cover the 12 months preceding our receipt of the verifiable consumer. Our response will also explain why we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide a cost estimate before completing your request.

Choices About How We Use and Disclose Your Personal Information

We strive to provide you with choices regarding the Personal Information you provide us. We have created mechanisms to provide you with the following control over your Personal Information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies. You can also choose to disable, via our cookie preference manager on our Website, certain non-essential cookies such as those used for analytics and marketing. If you disable or refuse cookies, please note that some parts of the Website may then be inaccessible or not function properly.

  • Promotional Offers from Zircon.  We will occasionally send you promotional materials that we think may be of interest to you. If you do not wish to have your email address or other contact information used by Zircon to promote our own or third parties’ products or services, you can opt-out by sending us an email stating your request to privacy@Zircon.com, or if you are already receiving marketing communications from Zircon, you can follow the “unsubscribe” instructions that are included at the bottom of each message or you may send an email to us at marketing@zircon.com asking to be omitted from future email distributions. Please note that if you unsubscribe from our marketing communications, you will still receive administrative messages relating to the functionality of Zircon products or services you use.

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal Information.

Specifically, we will not discriminate against you for exercising any of your CCPA and CPRA rights. Unless permitted by the CCPA and CPRA, we will not:

  • deny you goods or services;

Transfer of Personal Information to the United States of America

Our Website is directed to U.S. residents. The Personal Information that we collect through or in connection with the Website is, therefore, processed for the purposes described above in the United States even if you reside outside the U.S. We also need to process the Personal Information you provide us for the use of our Apps or other products, and we do so in the United States.  However, if it is necessary, we may subcontract the processing of, or otherwise share, your Personal Information with, affiliates or third parties in the United States or elsewhere. Zircon uses physical, electronic, and procedural safeguards to protect your Personal Information against loss or unauthorized access, use, modification, or deletion. However, no security program is 100% secure, and thus we cannot guarantee the absolute security of your Personal Information.

If you share Personal Information that belongs to another person, you confirm that that person has authorized you to act on his or her behalf, has consented to your sharing their Personal Information with us, and that you have the legal grounds to do so. Children’s Privacy

The Website is not directed to children under the age of 13, and Zircon does not knowingly collect personal or other information from anyone under the age of 13.
